'Breathtaking' decision on homeschooling
now moving to California Supreme Court

A "breathtaking" ruling from a California appeals court that could subject the parents of 166,000 students in the state to criminal sanctions will be taken to the state Supreme Court.

Justice H. Walt Croskey, whose opinion was joined by two other judges, then ordered: "Parents who fail to [comply with school enrollment laws] may be subject to a criminal complaint against them, found guilty of an infraction and subject to imposition of fines or an order to complete a parent education and counseling program."

It said under a section titled "Consequences of Parental Denial of a Legal Education" that "parents are subject to being ordered to enroll their children in an appropriate school or education program and provide proof of enrollment to the court, and willful failure to comply with such an order may be punished by a fine for civil contempt."

Specifically, the appeals court affirmed, the trial court had found that "keeping the children at home deprived them of situations where (1) they could interact with people outside the family, (2) there are people who could provide help if something is amiss in the children's lives, and (3) they could develop emotionally in a broader world than the parents' 'cloistered' setting."

This is absurd and out of control! These are our children and now the state of Calif.wants to tell parents how we must educate ourr children? I know many a homeschool children and they are very smart.I homeschooled my youngest child for a little while and then put him in Christian school! The public school system gets worse all the time!

    Overall, I really think kids should go to school, so they can get an education and also have social interaction with other kids. Maybe the people in California are fed up with the poor education, violence, promiscuity, and left wing agenda in the school system, and if that's the case, I don't blame them. I don't know what the problems specifically are, but the school system needs to address those issues and stop blaming the parents. Most parents just want what's best for their children.

    You understand why California is trying if it hasn't
    already ended home schooling? For one thing, children might end up not knowing how to put a rubber(condom) on a cucumber. Might not learn that there is nothing wrong, perverted, or immoral about homosexuals...............


    They will be at home learning how to think. Not what to think. If they are not in public schools having the benefits of the state teachers backed by the teachers union. How is the state ever gonna be able to indoctrinate the kids into marxism..or socialism.......or communism....the "liberal" way of what to think........................

    Parents should be free to choose where they send their children to school, my children where homeschooled, also went to a private christian school when we lived in the city, and when we moved to the country they were able to finish out there education in a small public school which was a very conservative school, it being so small, and the community being a small conservative community as well which was nice. They tried doing something like that in Texas many years ago, but the people shot it down quick!

    I think I have the right to choose what kind of education my child recieves and have done so.I do not believe in sending my child to "the government halls of indoctrination." Where they are not taught anything but to be dependant on the government.Etc,etc...

    Government schools are a predictable failure. They are failing miserably, as home schooling and private schools prove the clear superiority of responsible parental choice over state controlled education (liberal socialist indoctrination, actually) that only serves to dumb down our children.

    Parents should be in charge of their children - not the socialist state. Liberty-loving Americans should choose the education that the private market offers. If parents choose government schools, let their own funds support those schools. Ultimately, the sorry government schools will die the death that they deserve - while private, parochial, Christian, and home scholls continue to thrive.

    My parents were public school educators and administrators. They are now appalled at the condition of public education. Pure liberal tripe. There are positive exceptions but they are, sadly, only the exceptions. Shame on the Leftist teacher's unions and the National Education Association.     I really believe that it should be up to the parents how the want to educate their children. And it is not true that homeschooled children do not inner act with other children. Homeschooled children join sport teams, join scout troops, participate in music and all types of things.
    The only thing that the state should be concerned with is if the requirements are met, not where they are getting the education.

    Parents should have the right to educate thir child in the environment that they see fit. The only reason thet a child should be forced into another school environment, is if the child is failing. (hey I think all teachers need to be held accountable..If you are failing as a homeschooler, you should be fired as well!)

    The way some public schools are today, this surprises me only a little. I understand the pressures that the teacher's union is putting on government officials. I hope CA can secede from those unions but I doubt it.

    I also like the idea of allowing CA to secede from the US. They act like a foreign country anyway, why not?

    States have no right to interfere with parents who want to homeschool or place their children in a private school. This comes down to the fact that public education has failed our children in so many ways that parents have had enough. Many of us are worried about our kids and what they are being taught at school. Many public schools and teachers have a social ideological agenda and spend too much time indoctrinating our children rather than teaching them math, english and science. The other thing is that the teachers union has become so powerful that they control everything in the public school systems rather than the parents having control over their neighborhood schools. I rarely feel welcome and even when I have volunteered to help have been made to feel like I should not be there. For every student that is taken out of public school and put in private school or homeschooled the public school loses $ and when that happens public schools are forced to make budget cuts sometimes in teaching positions so the teachers unions are against homeschooling and always support property tax increases in communities and lobby state and federal government for more $ basically to retain their jobs, hire more teachers and increase salaries and to vote against anything like homeschooling that may stand in their way.

    I'd be happy if the education of our children went back to being a community responsibility instead of state and federal (because of the federal monies).

    I homeschooled my daughter for the first three grades and she has done well. She will be graduating from a public high school shortly. I think homeschooling is preferable to public schooling when the parents are able.
